Preliminary or regular hearing

Post by Tanda Knighthawke » Wed Aug 22, 2012 9:45 pm

A court action will be held on the recent murder in Skara Brae immediately following the High Council meeting August 27th. (If time runs tight this will be a prelim and another date will be set) The court action will be final (will hold trial status), unless some complicating factor arises.

The facts are mostly not at issue, and the accused has refused counsel.

(August 27, 2012)
Approximately 9 p.m.
Justicar Tanda Adkins brought the hearing to order
The defendant Rakst Lakoll
The Prosecution Britannia

Things were a bit unorthodox as the defendant had been openly admitting to the acts in question. Thus the Justicar interviewed Galen Knighthawke, Grand Marshal of the Britannian Armed forces, followed by an opportunity for the defendant to ask him questions.

The defendant was witnessed by the Grand Marshal, Edon M. of YM, Ariakas and Minister Malag Aste taking the life of a Rioter in Skara Brae. There were many random fires about, no direct attack on the defendant was witnessed.

The defendant asked the Grand Marshal if the Rioter in question wasn't in causing chaos and panic in Skara Brae, disturbing the peace. He also pointed out that there was no one less hungry mouth to feed and one less person to contribute to the civil unrest.

Grand Marshal Knighthawke was dismissed, and Justicar Adkins asked the defendant to take the stand. The defendant was asked the intent behind the attack of the Rioter. The defendant had intended him to be a late night snack.
When questioned further it was confirmed the defendant is by his own admission a vampire and thus had hoped to feed, but was arrested before that could take place.

The charge against Rakst Lakoll was that of murder, there was no violation at that time of the Vampirism Act.

With the defendant being undead, imprisonment for life is pointless as the jailers will pass away before the prisoner. Execution of an undead being can pose troublesome to accomplish. All prior attempts to effect a cure of vampirism to the Justicar's knowledge have been unsuccessful.

Justicar Adkins, retreated to her office to deliberate.
Upon return to the court room, the Justicar found the defendant guilty of murder, fined him the sum of 10,000 gold pieces payable to the family of the deceased or Skara Brae in the event of no kin with in 3 years time. Further the defendant was sentenced and exiled to the service aboard the ship of Captain Sayyida Al-Hurra. The good captain is allowed to seek her share of compensation along with overseeing the restitution payment. The defendant was also court ordered to feed upon the monstrous demonic beings.
