Summary of Chacellor Dakaren's amendment

Dear Members of the High Council:

Attached please find a summary I authored, for my wife, the Governor of and Councilor from Minoc, of the amendments to the HC Constitution proposed by Chancellor Dakaren. If I understood the Chancellor correctly, this summary is basically accurate, and he has made an alteration or two to his amendment on the basis of this summary revealing it did not quite work as he had intended. I was encouraged to post this. It is my understanding that the Chancellor will wish for these amendments to be voted on at the next High Council meeting (tomorrow night).

Constitution/HC Charter Changes:

Maintains but rearranges and rephrases certain passages related to the Field Marshal rank for leaders of BAF guilds (“branches”), including but not limited to their reporting to the Military Presidium. Otherwise, leaves certain passages substantially unchanged.

Removes guarding the High Council and arresting people from the list of BAF duties and functions.

Changes the procedures for “maintaining” the composition of the BAF (meaning the procedure for granting a guild membership, or taking away a guild's membership).

The new procedures for a guild's (or “branch”'s) entering the BAF if the changes are enacted will be as follows. A guild not affiliated with one of the main cities may request for membership through the Chancellor. A guild affiliated with one of the main cities shall apply through “their local Councilor or Governor.” Either way, the Military Presidium shall, by way of a majority vote give a “recommendation” to the High Council. That vote, and hence the Presidium's “recommendation,” stands unless it's overridden by a 2/3 vote of the High Council. Also, the Grand Marshal may make a temporary appointment of a guild to the BAF, which may last for one year.

The new procedures for a guild's (or “branch”'s) being removed from the BAF if the changes are enacted will be as follows. A guild may be removed by a majority vote of the Military Presidium. A guild also may be removed by a 2/3 vote of the High Council, subject to override by a 3/4 vote of the Military Presidium.

Provides for the removal of an individual from the BAF by way of a Court Martial, as established in the code of military justice. (Presumably this means that henceforth that will be the only manner or removing an individual from the BAF.)

Changes from mandatory to optional the Grand Marshal's forming a War Cabinet, and makes appropriate conforming changes throughout.

Removes the ability of the Grand Marshal's “Marshal's Decrees” to remove the immunity of a High Councilor.

Makes the granting of “Field Captain” status upon BAF members (presumably Field Marshals) optional, at the option of the Grand Marshal.

Throughout the document, replaces references to certain officials comprising the Military Presidium with references to the Military Presidium, by name. (So instead of listing all of the officials on the Military Presidium, it just says “the Military Presidium.”)

BAF Charter Changes:

Enacts certain edits having no substantive effect. (Removing word redundancies and so forth.)

Removes reference to the BAF being able to use “appropriate . . . force.”

Changes reference to the BAF not showing “gender” discrimination, to their not showing “sex” discrimination.

Restates the proposed entry/removal procedures from the proposed amendments to the Constitution.

Removes the ability of the Military Presidium to demand or force removal of branches of guilds or individuals. (Presumably this is to be replaced by the new procedures.)

Removes the requirement that BAF members recognize the Field Marshal and the Military Presidium. Replaces that requirement with a requirement to recognize the Grand Marshal's authority over that of “other officials or Field Marshals” and a requirement to obey Field Marshals, when a Field Marshal has field command.

States that the High Council may call upon Field Marshals to explain their actions to the Council “during the next council session” (presumably meaning the session following whatever act is being questioned).

Requires approval of the Grand Marshal for Field Marshals to command lawful military operations or training exercises.

Allows the Grand Marshal or the Military Presidium to appoint Field marshals as Field Captains. Specifies that field command by a Field Captain cannot contradict standing orders of the Grand Marshal; the High Council; or the laws of the Kingdom.

Removes the specification that Field Captains' authority cannot countermand orders by those higher in the chain of command (presumably higher than the Field Captains' typical rank).

Replaces “enemy occupation” with “monsters” when describing the duties of the BAF to defend the Shrines of Virtue.

Changes “may” to “will” when explaining how to deal with Enemies of the State who do not leave the High Council chamber.
